Our Services

Our goal is to help you care for aging adult or anyone that needs group support and help them live independently.

Required Devices

The person being cared for must have and wear a compatible smartwatch that detects falls and share data with Google Health and/or Apple Health. The cared for user must agree with KinectedCare's permission request to share health data with the group caring for them.

Medical Advice Disclaimer

Information, data and alerts from KinectedCare are for informational or educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. All users are strongly encouraged to consult with qualified healthcare professionals for any medical concerns.

Any and all use of information, data and alerts in the use of KinectedCare is user's own risk and does not establish a patient-provider relationship. Do not use this device if you have been advised by your healthcare provider that it is contraindicated for your condition. Use of KinectedCare is not a substitute for emergency medical services. If you experience an emergency you must immediately suspend your use and interaction with KinectedCare and call local emergency service providers.

Most smartphones have an “Emergency Call” button accessible from the lock screen. On both iPhone and Android devices, this allows you to dial emergency services without unlocking the phone.

Combating Harmful Conduct

People communicate openly when they feel safe and welcomed. Do not use KinectedCare for hateful or harmful activities.

Do Not Use KinectedCare If:

-- You are prohibited from receiving our products, services or software under applicable laws
-- We previously disabled your account for violating our terms or policies

What You Can Share and Do on KinectedCare

We want people to use KinectedCare to express themselves and to share content that is important to them. You, therefore, agree not to engage in the conduct described below or to facilitate or support others in doing so. Specifically, you may not use our Products:

-- In a way that violates these Terms or other terms and policies that apply to your use of KinectedCare
-- In a way that is unlawful
-- In a way that uploads viruses or malicious code or do anything that could disable, overburden or impair the proper working or appearance of our Products
-- In a way to access our servers or attempt to access data you do not have permission to access
-- In a way to disassemble or reverse-engineer our Products

Protecting Children

Users must not discuss, upload, share, or solicit any content involving the sexual exploitation of children. Violations will result in content removal and a permanent user ban. If you suspect any violation regarding the sexual exploitation of children you must immediately report it to local law enforcement agencies and notify us at support@steamboatsoftware.com

No Service Level Agreement

We're building a community that we hope will grow and thrive; we do not make any stated or implied service level agreement or assurance of delivery. KinectedCare operates by using your device(s) data from cellular and/or WiFi connections and your service will vary with your network's data connection strength and speed and we do not assume responsibility for those data services. You assume full responsibility for cellular and WiFi data consumption, usage fees and roaming fees

Updating our Terms

We work constantly to improve our services and develop new features to make our Products better for you and our community. As a result, we may need to update these Terms from time to time to accurately reflect our services and practices. We reserve the right to update our Terms at any time without any notice.

Limits of Liability

We work hard to provide the best Products we can and to specify clear guidelines for everyone who uses them. Our Products, however, are provided "as is," and we make no guarantees that they will always be safe, secure, or error-free, or that they will function without disruptions, delays or imperfections.

To the extent permitted by law, we also DISCLAIM ALL WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content they share (including offensive, inappropriate, obscene, unlawful, and other objectionable content).

We cannot predict when issues might arise with our Products. Accordingly, our liability shall be limited to the fullest extent permitted by applicable law, and under NO circumstances will we be liable to you for any medical provider costs, medical emergency costs, lost profits, revenues, loss of information or data, or consequential, special, indirect, exemplary, punitive or incidental damages arising out of or related to these Terms or our Products, even if we have been advised of the possibility of such damages.

Our aggregate liability arising out of or relating to these Terms or our Products will not exceed the greater of $1 USD or the amount you have paid us in the past 90 days.

Disputes

We provide clear guidance so everyone can avoid disputes. If a dispute does arise, however, it's useful to know up front where it can be resolved and what laws will apply.

For any claim, cause of action or dispute you have against us that arises out of or relates to these Terms or our Products ("claim"), you agree that it will be resolved exclusively in a state court located in Larimer County, Colorado, United States. You also agree to submit to the personal jurisdiction of this court for the purpose of litigating any such claim, and that the laws of the state of Colorado will govern these Terms and any claim, without regard to conflict of law provisions.

Entire Agreement

These Terms of Service make up the entire agreement between you and Steamboat Software LLC regarding your use of our Products and services. They supersede any prior agreements.

If any portion of these Terms are found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment to or waiver of these Terms must be made in writing and signed by us.

These Terms do not confer any third-party beneficiary rights. All of our rights and obligations under these Terms are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

We always appreciate your feedback and other suggestions about our products and services and we may use them without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential.

We reserve all rights not expressly granted to you.
